Hawaii is a great state with a booming tourist economy, beautiful ocean views, and tons of things to do. It is not such a great state when it comes to dealing with an inheritance or the Hawaii probate system. The Hawaii probate code is complex and massive. It has a set of rules before you even get to the codes and laws. If you have had to deal with the Hawaii probate system, you are familiar with
its bureaucratic nature. The first rule of the Hawaii probate code reads like a legal master’s dissertation:
“These rules govern the procedure in the circuit courts of the State of Hawaii in all probate, conservatorship, guardianship, trust, legal representation for no fault benefits, and determination of death proceedings, and more particularly proceedings arising under HRS Chapters 531 [Probate: Jurisdiction and Procedure], 532 [Descent of Property], 533 [Dower and Curtesy], 535 [Specific Performance of Deceased's Contracts to Convey Real Estate], 551 [Guardians and Wards], 551A [Office of the Public Guardian], 551D [Uniform Durable Power of Attorney Act] but only to the extent of issues arising from or between the attorney in fact and an incapacitated or deceased principal, 553A [Uniform Transfers to Minors Act], 554 [Trusts and Trustees; Accounts], 554A [Uniform Trustees' Powers Act], 554B [Uniform Custodial Trust Act], 554C [Uniform Prudent Investor Act], 556 [Uniform Fiduciaries Act], 557A [Uniform Principal and Income Act], and 560 [Uniform Probate Code] except Article V, Parts 2 and 6, and Section 603-21.6 [Probate Jurisdiction]. They shall be construed to secure the just, speedy, and inexpensive determination of every proceeding.”
Excuse me? No wonder it is such a lengthy process when it comes to recovering your inheritance in the state of Hawaii. You need a legal dictionary to read the basic introduction to the code! The fact is, even in the best of cases, dealing with an inheritance is a troubling process. First there is the loss of a loved one or loved ones. Then there is the hassle of dealing with the estate, figuring out what is in the estate and who gets what. Then things seemingly stop as the probate process begins and taxes have to be assessed, creditors have to be identified and paid. All of this happens long before you get what is rightly yours. If all went smoothly, this is likely to be a time consuming process. In Hawaii, this can be an 18-24 month headache. You have inherited money from a loved one who wanted you to have what was theirs. Inheritance and probate laws will slow that process down. In Hawaii, there are notices to be served, a lengthy mediation process, and a number of unique tax codes that might keep you from your money longer than you would think. So what can you do about it? You can allow us to help with an inheritance cash advance while you wait for the Hawaii probate system to sort itself out.
We understand that expenses exist and bills have to be paid. Sometimes more bills arise from the loss of a loved one, bills that are not included in the estate, medical bills or funeral related bills. The state of Hawaii does not concern itself with your issues. Hawaii's probate code is what it is, and Hawaii's probate process is not going to change anytime soon, regardless of your need to access the funds that rightly belong to you. You can, however, look into and apply for probate loans, even while the Hawaii probate system has the estate locked down as it goes through the estate with a fine tooth comb, assessing all of the details.
If you have a need for your funds and are waylaid by the Hawaii inheritance system, we might be able to assist you, as we have so many others in the state of Hawaii, with inheritance loans. We cannot make the probate court stop or speed up the release of your inheritance, but we can make the lengthy process of waiting far more livable. Why torture yourself as the Hawaii inheritance system drags on and on. We can help you with liquidity while notices are filed, creditors are contacted, taxes are assessed and mediation is considered in the state of Hawaii, and maybe you can move on from your loss and enjoy some of the grand beauty of the most beautiful state in the whole Union.
